General Conditions of Sale GCS
Article 1 – Object and application
These General Conditions of Sale are about all the selling between the customer and L'ingénueuse CUSTOM, whether remotely, by a natural person acting as a consumer, via lingeneuse.fr website, the e-mail address
We invite you to read these conditions carefully because by using the services offered therein, you expressly agree to be bound by them.
These GCS are not applicable to professionals, i.e. to any natural or legal person, public or private, who acts for purposes falling within the scope of his commercial, industrial, craft, liberal or agricultural activity, including when acting in the name or on behalf of another professional.
The ingenuous CUSTOM reserves the right to make changes at any time to these General Sales Conditions, to the various services and products offered as well as to the platforms via which they are offered.
In the event that one of the clauses of these conditions is deemed null and therefore inapplicable, this will not affect the validity of all the remaining stipulations of the GCS.
Article 2 – Price
The prices of our products and services are indicated in euros, all French taxes included (VAT and other taxes applicable on the day of the order), unless otherwise indicated and excluding processing and shipping costs. In the event of an order to a country other than metropolitan France, you are considered to be the official importer of the product(s) concerned. Customs duties or other local taxes or import duties or state taxes may be payable. These duties and/or taxes are exclusively at your expense and are your entire responsibility, both in terms of declarations and payments to the competent authorities and bodies in your country. We advise you to inquire about these aspects with your local authorities before placing an order.
All orders, whatever their origin, are only payable in euros. The ingenuous CUSTOM reserves the right to modify its prices at any time in compliance with the legislation applicable in France. However, the products or services will be invoiced on the basis of the tariff in force at the time of the validation of the order.
Article 3 – Orders
You can place an order via the various platforms mentioned above in Article 1 of these conditions. Orders made via the contact form or the Facebook and Instagram platforms are redirected to the website at the email address
Article 4 – Corfirmation of your order
Any quote validated, i.e. signed electronically, assumes full and complete adherence to these General Terms and Conditions of Sale without exception or reservation. All the data provided, the signed estimate and the paid order, will constitute proof of the transaction. A summary of the information of your order and of these General Conditions will be sent to you in PDF format via your e-mail address.
Article 5 – Payment
The validation of your order implies for you the obligation to pay the price indicated. Payment for your purchases is made securely either by bank transfer or by electronic payment: Paypal, Paylib, Lydia. Once the payment has been validated, you are then debited with the amount of your order.
Article 6 -Risks tranfer
The transfer of risks is deferred at the time of delivery of the order to the carrier. Thus, the risks are transferred to you from the moment you are physically in possession of the order. It is then your responsibility at that time to check the state of receipt, to make reservations on the order form and to exercise recourse either against the carrier for any damage or loss related to transport and /or on delivery, or against us via e-mail to
Article 7 – Withdrawal
In accordance with the provisions of article L.221-28 of the French Consumer Code, you do not have the period of 14 days from the conclusion of the contract to exercise your right of withdrawal because this right does not apply to contracts. according to alinea 1 and 3:
1° For the provision of services fully performed before the end of the withdrawal period and the performance of which has begun after the express prior agreement of the consumer and express waiver of his right of withdrawal (…)
3° Supply of goods made to the consumer's specifications or clearly personalized (…)
As a result, the activity of L'ingénueuse CUSTOM being exclusively the provision of personalized services, no service whose execution having begun after express validation of the order could in principle be subject to withdrawal.
However, L'ingénueuse CUSTOM grants you a period of three (03) days to proceed with the cancellation of your order, this period corresponding to the processing and receipt of payment made for it.
Thus, any cancellation of order beyond this period of three (03) days, will still remain remunerated in accordance with article L221-25 of the Consumer Code.
Article 8 – Delivery
The delivery will be made according to your choice: either by parcel relay (Mondial relay, Shop2shop...)for France, or by delivery registered by Chronopost for France and the rest of the world.
In addition, we invite you to check the condition of the packaging of your package before accepting it by affixing your signature on the paper or electronic delivery slip. If you recover it with packaging defects, we invite you to make reservations on the said slip.
The products are delivered to the address of your choice indicated during the ordering process. In case of late shipment, an email will be sent to you to inform you of any consequences on the delivery time indicated to you. You also have the possibility of informing us of any delay in delivery of your order via our e-mail. In accordance with the legal provisions, in the event of late delivery, you benefit from the possibility of canceling the order under the conditions and methods defined in article L 138-2 of the Consumer Code, i.e. by letter registered mail with acknowledgment of receipt within thirty (30) days after the conclusion of the contract. If you receive the order beyond the legal period of thirty (30) days, we will refund the sums paid as well as the return costs under the conditions listed in article L138-3 of the Consumer Code.
However, L'ingénueuse CUSTOM cannot be held responsible for the delay in delivery due exclusively to the unavailability of the customer after several delivery proposals.
Article 9 – Non-compliance of the order / damaged item
It appears from article L121-20-3 of the Consumer Code, that L'ingénueuse CUSTOM, as a professional, is automatically responsible to the consumer for the proper performance of the obligations resulting from the contract concluded at distance, whether these obligations are to be performed by the professional who concluded this contract or by other service providers, without prejudice to his right of recourse against them; on the other hand that he can exonerate himself from all or part of his liability by providing proof that the non-performance or poor performance of the contract is attributable either to the consumer or to the fact, unforeseeable and insurmountable, of a third party to the contract, or to a case of force majeure. In the event of an anomaly concerning the delivery, that is to say in the event of defective articles or non-conforming in kind (error of colour reference), the Customer must, as soon as possible, send his complaints to L'ingénueuse CUSTOM by email, to the following address:
Any complaint formulated beyond the 3 days following the delivery cannot be accepted.
The absence of complaints, the non-issuance of reservations by the Customer mean that the delivered item is deemed satisfactory and cannot be the subject of any subsequent dispute.
Article 10 – Force majeure
Force majeure means, without this list being exhaustive, declared or undeclared war events, general work strikes, epidemic diseases, quarantine, fire, exceptional floods, accidents or disasters. other events beyond the control of L'ingénueuse CUSTOM. It will therefore not be held responsible for the delay observed due to events of force majeure.
In case of force majeure noted by L'ingénueuse CUSTOM, it will inform you in writing or by any other means. It will be up to you within 10 days either to maintain your order until it is able to be shipped to you or to cancel it in order to obtain a partial or total refund depending on its degree of completion.
Article 11 – Personnal data
The data collected via the e-mail
However, please note that any absence or refusal to communicate all of your data cancels the process of processing your order if it is in progress and your data will be deleted from all our databases.
The data collected is intended for the company L'ingénueuse CUSTOM.
They will be kept for a period of five (05) years in accordance with Article L.110-4 of the Commercial Code. After this period, your data will be deleted from our databases.
In addition, you have rights of access, rectification, erasure, limitation, opposition, where applicable portability. You also have the right to define directives relating to the storage, erasure and communication of your personal data after your death.
If necessary, you can withdraw your consent to the processing of data, which will have the effect of stopping it.

If you believe, after contacting us, that your "Computer and Freedoms" rights are not respected, you have the right to lodge a complaint with the CNIL (www.cnil.fr).
In addition, L'ingénueuse CUSTOM will archive purchase orders and invoices on a reliable and durable medium for probative purposes, in accordance with Article L. 123-22 paragraph 2 of the French Commercial Code. The computerized registers of L'ingénueuse CUSTOM will be considered by all parties concerned as proof of communications, orders, payments and transactions between the parties.

These General Conditions of Sale take effect from April 1, 2022.
